The Non-Resident Landlords Scheme

An overseas landlord may fall within HMRC’s Non-Resident Landlords Scheme, commonly referred to as the NRLS.

For the purposes of the scheme, a non-resident landlord is generally someone whose usual place of abode is outside the UK and who receives income from UK property. The scheme can apply to individuals, companies and some trusts.

Unless HMRC has authorised the landlord to receive rent gross, a letting agent may normally be required to deduct basic-rate tax from the relevant rental income and account for it to HMRC. An individual landlord can apply to HMRC using the relevant non-resident landlord process to receive rent without deduction, but HMRC approval does not remove the landlord’s obligation to declare taxable rental income.

Where the property is jointly owned, each non-resident owner may need to be considered separately under the scheme.
